Terms of Use

These Terms of Use ("Terms") are an agreement between you and Appsolutely LTDA ("Appsolutely", "we", "us"), the company that publishes the DivineClock mobile application and its services (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

The App is also licensed to you under Apple's Licensed Application End User License Agreement (the "Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms supplement the Apple Standard EULA; if there is a conflict, the consumer-protective provisions of the Apple Standard EULA prevail.

1. The service

DivineClock is a faith-based alarm app. When an alarm rings, the intended way to dismiss it is to read the assigned Bible verse aloud; your device's speech recognition confirms the reading and then stops the alarm. The App also includes a reading journal, streaks, a 90-day challenge, and a referral program.

2. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your own non-commercial use, as permitted by the Apple App Store Terms of Service.

3. Eligibility

You must be at least 13 years old, and old enough to form a binding contract, to use the App. By using it, you represent that you meet these requirements.

Important — alarm reliability. DivineClock schedules alarms using Apple's system alarm features. While we aim for alarms to ring reliably, we cannot guarantee that any alarm will ring or that speech recognition will work in every situation. Many factors are outside our control, including your device being off, out of battery, muted, in a restricted power mode, denied microphone or alarm permissions, operating-system limitations, or background noise. Do not rely on DivineClock as your only method for waking up when missing a wake-up could cause harm or loss. You use the alarm feature at your own risk.

The App may let you invite others with a code and earn a reward (such as a free subscription period delivered through Apple offer codes) when invited users qualify. Referral rewards are a courtesy, not an entitlement, and are subject to rules that may change. We may withhold or revoke rewards and disable the referral feature for behavior we reasonably consider fraudulent or abusive (for example, self-referral, fake devices, or automation). Apple App Attest is used to help ensure invites come from genuine app installs.

The App presents Bible verses and related content, which may be retrieved from third-party scripture sources. Such content is provided for personal, devotional use on an "as is" basis. Translations and references may contain errors, and we do not warrant their completeness or accuracy.

8. Intellectual property

The App, its design, branding, and original content are owned by DivineClock and protected by applicable laws. These Terms do not grant you any rights in our trademarks or content except the limited license above.

9. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, and any warranty that the App will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, DivineClock will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, missed wake-ups, missed appointments, or lost profits, arising out of or relating to your use of (or inability to use) the App. To the extent liability cannot be excluded, it is limited to the amount you paid for the App in the twelve months before the event giving rise to the claim.

You may stop using the App at any time and delete it. We may suspend or terminate your access if you breach these Terms or misuse the service. Sections that by their nature should survive termination will survive.

12. Apple App Store terms

These Terms are between you and DivineClock only, not with Apple. Apple is not responsible for the App or its content. To the extent the Apple Standard End User License Agreement (EULA) applies to your download, it applies in addition to these Terms; if there is a conflict, the consumer-protective provisions of the Apple Standard EULA prevail. Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.

13. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules. Subject to applicable mandatory consumer protections, disputes will be submitted to the competent courts of Brazil.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
